Terms and Conditions

Welcome to HesabPay! These Terms and Conditions (the "Agreement") govern your use of the HesabPay mobile application, website, services, and any associated features or functionalities (collectively referred to as the "Services"). By creating an account, accessing, or using HesabPay, you agree to be bound by this Agreement. If you do not agree to these terms, you may not use HesabPay.

1. Account Creation and Usage

1.1 Instant Account Creation

You can create a HesabPay account instantly using your mobile phone number. By registering, you confirm that the phone number belongs to you, is valid, and may be used for verification purposes.

1.2 Services Provided

HesabPay account holders can avail themselves of services including, but not limited to:

  • Sending and receiving money from linked bank accounts.
  • Making purchases at registered merchant stores using payment cards.
  • Withdrawing cash from registered HesabPay agents using payment cards.
  • Disbursing salaries to employees or contractors.
  • Transferring funds to friends and family worldwide through HesabPay accounts, bank accounts, or other money accounts, including cash-out agents.
  • Utilizing third-party services, such as hotel and flight bookings, or purchasing gift cards (subject to third-party terms).
  • Paying utility bills including electricity (Breshna), internet, TV subscriptions, and government fees.
  • Purchasing mobile top-ups and data bundles for any carrier worldwide.
  • Ordering food delivery through the in-app Food Ordering service.
  • Booking taxis, doctor appointments, and intercity bus travel.
  • Using the USSD *580# service for payments without internet access on any mobile phone.

1.3 Linking and Unlinking Payment Cards

Users may link their bank accounts via payment cards and/or login credentials, provided that the cards/accounts have at least 30 days of validity remaining. Unlinking of payment cards can be performed through the account settings, though HesabPay retains transaction records for compliance and security purposes.

1.4 HesabPay Visa Card

Users may apply for a HesabPay Visa Card, which enables online purchases on international websites, in-store payments at merchants worldwide, ATM cash withdrawals from any Visa-enabled ATM globally, and currency exchange at Da Afghanistan Bank rates. The Visa Card is issued in partnership with licensed banking institutions and is subject to applicable card network terms and conditions.

2. Features and Services

2.1 Ask HesabPay (AI-Powered Assistant)

The "Ask HesabPay" feature is an AI-powered payment assistant that allows users to initiate transactions, pay bills, purchase top-ups, check balances, and perform other financial operations through natural language commands. By using this feature, you consent to the sharing of your input data with AI systems for processing. All transactions initiated through AI require standard authentication before execution.

2.2 Statements and Reports

Users can access, download transaction statements, and receive notifications for processed transactions. Detailed activity breakdowns are available within the app. HesabPay does not charge fees for accessing statements or reports.

2.3 Adding Balance

HesabPay functions as a custodial wallet service that holds user funds at a 1:1 ratio in the banking system. HesabPay does not invest, transfer, or use your funds under any circumstances without your explicit consent. Funds can be withdrawn at any time.

2.4 E-Hawala (Cash-Out Transfers)

The E-Hawala feature allows users to send money to any person, including those without a HesabPay account. Recipients receive an SMS notification and can collect cash from any of HesabPay's 1,200+ agents nationwide.

2.5 Third-Party Services

HesabPay facilitates access to third-party services, wherein users can engage in activities such as hotel bookings, flight bookings, food ordering, and gift card purchases. These services are governed by their respective terms and conditions. HesabPay disclaims responsibility for issues emerging from third-party services.

2.6 Salary or Bulk Disbursements

HesabPay users can disburse salaries or make bulk payments to up to 100,000 recipients through the enterprise web platform. Users are solely responsible for ensuring that all recipient details are accurate. Payments initiated are non-refundable.

2.7 Merchant Payments and HesabPOS

Users can facilitate payments to merchants via QR code scanning, NFC tap-to-pay, or payment cards. Eligible merchants may use HesabPOS terminals and mPOS devices to accept Visa, Mastercard, American Express, UnionPay, Discover, JCB, Apple Pay, and Google Pay.

2.8 Developer API and Integrations

HesabPay provides RESTful APIs, WooCommerce/WordPress plugins, and split payment capabilities for developers and businesses. Use of developer tools is subject to the HesabPay Developer Agreement at developers.hesab.com.

3. Transfers and Receiving Payments

3.1 Transfer Money

Users can transfer funds to other users via HesabPay accounts, bank accounts, or cash-out agents. Limits on transaction amounts may apply based on jurisdictional regulations.

3.2 Receiving Payments

Payments received are automatically credited to linked accounts. For discrepancies, users must contact the sender or their respective banks.

3.3 Payment Cancellation

Payments made are final and cannot be canceled or reversed. Users are strongly encouraged to double-check recipient details before confirming transactions.

3.4 Refund and Reversal Policy

If a transaction was made between HesabPay users and the funds have not been spent or withdrawn by the recipient, our team will initiate a reversal upon recipient consent. If a transaction failed but funds were deducted, the amount will be credited back after verification. For third-party services, refund policies of the respective service providers apply.

4. Fees and Maintenance Charges

4.1 Monthly Maintenance Charges

  • Active Accounts: 15 Points will be deducted monthly.
  • Inactive Accounts: AFN 15 will be deducted monthly.

HesabPay reserves the right to adjust maintenance fees with reasonable notice.

4.2 Auto-Renewal

All service packages renew automatically. Users can cancel auto-renewal via the app. Refunds for auto-renewal charges will only be granted under exceptional conditions.

5. Security and Authentication

5.1 Identity Verification

HesabPay may require users to authenticate their identity using government-issued identification documents. Failure to provide documentation may result in account suspension or termination.

5.2 Fraud Prevention

Suspicious activities will be referred to the appropriate authorities. Users are advised to verify all communications from HesabPay and be wary of phishing scams. All transactions are secured using blockchain technology.

6. Intellectual Property

All intellectual property associated with HesabPay, including the application, website, text, graphics, and logos, are owned by HesabPay, Inc. Users are granted a limited, non-transferable license for personal, authorized use. Unauthorized use is strictly prohibited.

7. Termination

  • Engaging in fraudulent or illegal activities.
  • Violation of this Agreement.
  • Using an unregistered phone number for account creation.
  • Court or government orders mandating termination.

8. Limitation of Liability

  • Loss of funds due to user error.
  • Issues arising from the use of third-party services.
  • Loss of encrypted data processed through third-party providers.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Delaware, United States. Parties agree to first attempt resolution through negotiation or mediation prior to litigation.

10. Amendments

HesabPay reserves the right to amend this Agreement. Users will be notified of changes, which take effect upon the next usage of the Services.
